Moms Classifieds nor any of its partners or providers of information make any warranties, express or implied, as to results to be obtained from use of such information, and make no express or implied warranties of merchantability or fitness for a particular purpose or use. Moms Classifieds nor any of providers of information shall have any liability for the accuracy of the information contained in the service, or the contents of any advertisements, or for assertions or omissions therein. Moms Classifieds nor any other party shall be liable to any other party or any third-party for third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Moms Classifieds reserves the right to remove any listings, postings or advertisements at its sole discretion and for any reason. In no case shall Moms Classifieds be liable for any information contained in any listings, postings, or advertisements. In no case shall Moms Classifieds be liable for any costs or events that occur beyond its control including, but not limited to, network outages, Internet connectivity problems and client side browser issues.

DISCLAIMER OF WARRANTIES:
You expressly acknowledge and agree that use of Moms Classifieds is by your own free will and at your own risk. Moms Classifieds shall not be responsible to you for any content found on Moms Classifieds for any reason whatsoever. Moms Classifieds expressly disclaims all warranties of any kind, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and legal use and enjoyment. Moms Classifieds will strive to meet the needs of its sellers and buyers, but makes no warranty or implies that Moms Classifieds will be timely, secure, error free, or meet your requirements; nor does Moms Classifieds make any warranty or guaranty as to the results that may be obtained from the use of Moms Classifieds or as to the accuracy or reliability of any information obtained through Moms Classifieds. No advice or information, whether oral or written obtained by you from Moms Classifieds shall create a warranty not expressly made herein. You understand and agree that any content downloaded or otherwise obtained through the use of Moms Classifieds is done at your own discretion and risk and that you will be solely responsible for any damages to your computer or loss of data that results in the downloads of such content. To the full extent permissible under the applicable law, Moms Classifieds shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use Moms Classifieds or for the cost of procurement of substitute goods and services resulting from any goods or services purchased or obtained through your use of the Moms Classifieds classified ads system.

The following disclaimer and terms of use apply generally to all postings to the Moms Classifieds site and its sister sites, if applicable. It is hereby also understood that any person posting to Moms Classifieds will have been presented with this disclaimer and terms of use prior to doing so and, as such, be subject to its terms as indicated below.

CONDITIONS OF USE:
You are solely and entirely responsible and liable for all postings to Moms Classifieds. Listed below are some, though not all, violations that may result in Moms Classifieds deleting your postings. By posting a listing or advertisement, you agree not to do any of the following requests while posting an ad to Moms Classifieds.
· harass, threaten, embarrass or slander any person or entity;
· transmit via Moms Classifieds any information, data, text, files, links, software, chat, communication or other materials ("Content") that may be considered to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable;
· impersonate in Moms Classifieds any business or person, living or dead, famous or not;
· intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law in connection with using or accessing of Moms Classifieds in any manner.

FEES AND COSTS INCURRED:
Moms Classifieds does not require you to mail or ship your Moms Classifieds item to a buyer unless you agree to accept payment and arrange for shipping of an item. You may always specify and require “local delivery and pickup only” in your listing. If you agree to mail or ship an item to a buyer, only shipping costs actually incurred may be charged to the buyer. No additional fees, bank charges, handling costs, packing fees, or material costs can be added to the buyer’s final costs, other than actual shipping costs. The purpose behind Moms Classifieds is to offer an affordable alternative to buy and sell used items. If you wish to pad your sales by adding additional processing or shipping fees, please go elsewhere. We take this policy very seriously, and charging excessive fees for “packaging and handling” or charging for shipping above actually costs could result in your being banned from Moms Classifieds.

ACCEPTING PAYMENT FOR LISTING:
Moms Classifieds does not guaranty payment or delivery of any items listed in Moms Classifieds. You, as the seller, are responsible to determine the methods of payment you are willing to accept, whether it is via check, money order, cash, PayPal, or a credit processing service. No additional processing fees or bank charges can be added to the buyer’s final cost. The purpose behind Moms Classifieds is to offer an affordable alternative to buy and sell used items. If you wish to pad your sales by adding additional processing fees, please go elsewhere. We understand that there are fees associated with taking credit card and some PayPal payments. We suggest you price your item to include these fees, or accept only payments that do not have processing fees associated with them.

INTELLECTUAL PROPERTY:
You agree that you will not upload or transmit any Content to Moms Classifieds that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party. By submitting Content to Moms Classifieds you automatically grant -- or warrant that the owner of such Content has expressly granted -- Moms Classifieds the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such Content.

CONTENT:
You must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. Moms Classifieds shall not be responsible for any Content, including grammar, punctuation, and spelling. Moms Classifieds shall have the right, but not the responsibility, to remove Content which is deemed in its sole discretion harmful, offensive, illegal or otherwise in violation of this Agreement or any rules Moms Classifieds has in place at the time. Moms Classifieds may elect at its sole discretion to monitor some, all, or no areas of Moms Classifieds for adherence to this Agreement or rules at a frequency of its own discretion.

SPECIFICALLY FOR BUYERS:
The following disclaimer and terms of use apply generally to all postings to the Moms Classifieds site and its sister sites, if applicable. It is hereby also understood that any person purchasing an itemed posted to Moms Classifieds will have been presented with this disclaimer and terms of use prior to doing so and, as such, be subject to its terms as indicated below.

FEES AND COSTS INCURRED:
Moms Classifieds does not require posters to mail or deliver items out of their area unless they specifically agree to do so, accept payment and arrange for shipping of an item. Moms Classifieds does not guaranty delivery of any items. Arrangements must be made with the poster of the item. If the poster agrees to mail an item to a buyer, only shipping costs actually incurred may be charged to the buyer. No additional fees, bank charges, handling costs, packing fees, or material costs can be added to the buyer’s final costs, other than actual shipping costs. The purpose behind Moms Classifieds is to offer an affordable alternative to buy and sell used items. If a poster attempts to “pad the sale” by adding additional fees to the shipping costs, please contact us. We believe that the practice of padding sales by charging excessive shipping fees is dishonest, and will take swift steps to rectify the situation.

PAYING FOR AN ITEM:
Moms Classifieds does not guaranty delivery, quality, or usability of any items listed in Moms Classifieds. You, as the buyer, are responsible to determine the methods of payment you are willing to use, whether it is via check, money order, cash, PayPal, or the poster’s credit processing service. It is Moms Classifieds’ specific policy that no additional processing fees or bank charges, can be added to a buyer’s final costs. The purpose behind Moms Classifieds is to offer an affordable alternative to buy and sell used items. If a poster attempts to “pad the sale” by adding bank fees, please contact us. We believe that the practice of padding sales by charging excessive bank and processing fees is dishonest, and will take swift steps to rectify the situation.
